Intellectual property

Fundamental principles

The °ÄÃÅÁùºÏ²Ê¸ßÊÖ Project is an international scientific and technological project where intellectual propertyÌýwill be used and created by different legal entities during the construction of the facilities and their operation. Therefore, when the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization was established by the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement to construct, operate, and exploit the °ÄÃÅÁùºÏ²Ê¸ßÊÖ facilities, principles concerning intellectual property were incorporated in Article 10 of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement and detailed in its Annex onÌýInformationÌýandÌýIntellectual Property.Ìý

These fundamental principles are the following:

  • In the frame of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Project, each Member shall provide its contributions to the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization in kind, through an appropriate legal entity: the Domestic Agency;
  • The °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization and the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Members, acting through a Domestic Agency or entity, shall support the widest appropriate dissemination of information and intellectual property they generate in the execution of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement;
  • In carrying out its activities, the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization shall ensure that any scientific results shall be published or otherwise made widely available after a reasonable period of time to allow for the obtaining of appropriate protection (copyright on works based on those results is the property of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization);
  • When placing contracts for work to be performed pursuant to the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement, the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization and the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Members shall include provisions in such contracts on any resulting intellectual property which shall:
    • address inter alia rights of access to, as well as disclosure and use of, such intellectual property; and
    • be consistent with the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement and the IIP Annex.
  • Intellectual Property generated or incorporated pursuant to the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement shall be treated in accordance with the provisions of theÌýAnnex on Information and Intellectual Property.

As a result, the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization and the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Members are required, under certain conditions, to share backgroundÌýand generated intellectual property by way of license agreements or commercial arrangements, the provisions of which are more or less stringent depending on the use envisaged for the purpose of publicly sponsored fusion R&D programs, of commercial fusion, or uses other than for fusion.

Information shall mean published data, drawings, designs, computations, reports and other documents, documented data or methods of research and development, as well as the description of inventions and discoveries, whether or not protectable, which are not covered by the term "intellectual property."
Intellectual property shall have the meaning defined in Article 2 of the Convention Establishing the World Intellectual Property Organization signed in Stockholm, Sweden, on 14 July 1967. For the purposes of this Annex, intellectual property may include confidential information such as know-how or trade secrets, provided that they are unpublished and in written or otherwise documented form, and a) have been held in confidence by their owner and, b) are not generally known or available to the public from other sources and/or are not generally available to the public in printed publications and/or other readable documents, and c) have not been made available by their owner to other parties without an obligation concerning confidentiality, and d) are not available to the receiving party without an obligation concerning confidentiality.)
Background intellectual property shall mean intellectual property that has been or is acquired, developed or produced before the entry into force of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement, or is outside the scope of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement.
Generated intellectual property shall mean intellectual property that is generated or acquired with full ownership by an °ÄÃÅÁùºÏ²Ê¸ßÊÖ Member, acting through a Domestic Agency or Entity, or by the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization or jointly pursuant to and in the course of the performance of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Agreement.

Intellectual property management

The management of intellectual property at the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization is supervised by the Intellectual Property Board. It assesses all aspects of intellectual property protection and monitors the operation of the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization's intellectual property database.

A Publication Board has been established to oversee the implementation of the publication procedure.

Intellectual property and contractors

The principles of the Annex on Information and Intellectual Property are incorporated in the °ÄÃÅÁùºÏ²Ê¸ßÊÖ Organization's contractual conditions. According to these, the contractors will provide a Background Declaration during the contracting process.
